The court process can be extensive, time-consuming, and unpredictable, and we want to provide you with the skilled and compassionate guidance you need. Navigating Child Custody Laws
Child custody is not limited to physical location. It also grants decision-making authority to one or both parents.
A Virginia family court may grant one of the following custody arrangements:
- Joint legal custody: both parents share responsibility and decision-making authority for the care and control of the child
- Joint physical custody: both parents share physical and custodial care
- Sole custody: one parent has the primary responsibility and decision-making authority for the care of the child
The court generally grants shared custody unless evidence suggests this would not be in the children’s best interests, such is with cases involving domestic violence. If parents do not live together and the court sees that they cannot or will not communicate appropriately, it will most likely award sole custody to one parent. In less common cases, the court may award custody to a non-parent.
What Is Visitation?
If only one parent has custody over their children, the other parent will most likely be entitled to visitation (i.e. time spent with their children). If you and your children’s other parent cannot agree to a visitation schedule, the court will order one. The arrangement can include general schedules as well as plans for holidays throughout the year.
